GENERAL CONDITIONS ON CATAMARAN SERVICES 2019

CATAMARAN SERVICES GENERAL CONDITIONS 

At the time of the execution of any service agreement with The Company, they hereby represent their full knowledge and acceptance of these General Conditions, which will be applied at such moment either directly or through an authorized Agent upon the written confirmation of the services to be rendered either directly by the Company or any third party and may not at any time ignore them or claim the lack of knowledge thereof.

Quotes and reservations

–Quotations involving services do not imply the reservation thereof until they have been expressly requested and confirmed in writing by the Passenger and/or Authorized Agent and subsequently confirmed by the Company by mail or phone or the other way to confirm reservations.

–The published rates, quoted rates, confirmed and guaranteed rates, are subject to change in any of the following three circunstances imposed by the Government of Bolivia a) Government Modification on fuel prices, b) Government Modification on taxes and entrance fees for public tourist attractions, c) Government Modification on the parity change between the dollar and our local currency.

– Children under two years old, travel at no charge (This does not including meals , beds or bus seats); children between two and eight (2-8) years old are subject to half fare payments. Hotels and other services contracted by the Company may have other additional regulations.

Cancellations and reimbursements

-If the cancellation is 21 to 30 days before arrival date, there will be a charge of 5%, from 10 to 20 days before arrival date there will be a charge of 25% from the rate. If the service is cancelled 5 to 9 days before arrival date, a 45% of the rate will be charged. If the service is cancelled 4 days or less before arrival date, a No Show rate of 100% will be charged.

Documents, Visas y Vaccines:

– All passengers must carry throughout the entire trip valid documentation such as passports, visas, vaccine certificates and others which may be requested pursuant to law.

– The information on the requirements to enter and leave either Peru or Bolivia is not the responsibility of the Company.

 Accountability:

– The Company is not accountable for any unpredictable events during any trip such as: acts of government, blockades, war, civil unrest, revolts, terrorist acts, epidemics, quarantines, adverse weather conditions, winds, lake storms or any other event which is out of the control of the Company or its providers.

– Land and water Transportation both domestic and abroad are liable to overbooking, cancellations, and reprograms; in such cases the Company will make its best efforts to aid the passengers to reach their respective travel means or make the necessary alternative arrangements. Such actions will be courtesy of the Company to its clients, and therefore the Company is not responsible for embarking arrangements, additional payments due to tariff differences or hotel accommodations, meals and additional transfers which the transportation Company may provide due to the cancellation or delay in their departures.

– The Company is not accountable for damages, flaws, losses, additional costs, additional delays or any other irregularities which may take place due to the negligence or omission of other companies or individuals that offer or grant travel, hotel and other services thereto related, acts of nature and any other similar events.

– The Company retains services from several different independent providers which are not subject to, nor under its control and thus the Company will not be accountable for deaths, personal injuries or losses that may occur while such services are being rendered  or any other events on which the Company does have any control.

Insurance:

– Transturin Catamaran company passengers are covered y an Accident Insurance Policy during its services for up to Ten thousand 00/100 US Dollars ($10.000.00)  for accidental death or permanent incapacity and up to Five thousand US Dollars ($5.000.00) for medical expenses.  Any amounts over the foregoing will be covered by the passenger, its travel insurance or any other insurance that may have been taken by the passenger or its travel agents. The Company will not acknowledge any claims for amounts over the ones established, which are hereby accepted by the passenger or travel agent at the time of the reserve confirmation.

– The insurance policy covers passengers up to 70 years old; any passengers over that age limit must acquire their own insurance against accidents and others.

– Any services related to extreme sports or which may represent unreasonable material risks is not cover by our insurance and thus the Company waives any accountability thereon.

– The Company will be responsible for all luggage that has been consigned to its warehouse. Any damage not attributable to the regular handling or total loss is covered for up to One thousand 00/100 US Dollars ($1.000.00). Hand luggage and personal effects are the sole and exclusive responsibility of the passengers and the Company waives any accountability thereon.

Special conditions for the Catamaran:

– If for any circumstances alien to the control of the Company, the catamaran services are suspended, the Company will proceed as follows: A) Return to the point of origin of the service and the Company will reimburse 100% of the fees paid.  B) Transport the passengers to the new point of destination amending itineraries and schedules, in which case the Company will charge 100% of the service that has been quoted.

– The Company may, without any prior notification or notice, modify its schedules and/or itineraries.

– The Company is not accountable for any detriment or delays in its itineraries and others.

Applicable law:

Any type of controversies, legal claims, conflicts, on, before and after the services have been rendered by the Company is subject to the exclusive laws of the Plurinational State of Bolivia.
